Show-Me State Shows Nation’s 45th Data Breach Law
Posted on August 24th, 2009 No commentsAdding to America’s crazy quilt scenario of similar-but-different state laws and regulations facing retailers,a new data breach notification law goes into effect in Missouri Friday (Aug. 28). There are now 45 states with such measures, according to the National Conference of State Legislatures.The Missouri law is similar to most other state laws dealing with data breach notifications, but it includes medical and health information, data the states usually don’t mention because it is protected by the federal Health Insurance Portability and Accountability Act (HIPAA).

The answer is “yes,” according to Nevada, which has passed a new law that, as of next year, requires businesses to comply with PCI when collecting or transmitting payment card information. As states rush to adopt or strengthen privacy legislation, Nevada’s move is seen by some observers as a potential “game-changer.” But they question whether states should be in the business of mandating compliance with an industry standard.

Heartland Tests End-to-End Encryption; Gets Good Reviews
Posted on July 6th, 2009 No commentsAnalysts: Industry Standard is Real Key to Thwarting ThreatsIn the first step of its move toward end-to-end encryption, Heartland Payment Systems (HPY) last week completed the first phase of its pilot project. Heartland, the sixth biggest payments processor, earlier this year announced that it was hit with a data breach, wherein credit card numbers and debit card information were taken by hackers who broke into the payment processor’s internal network. Since the breach was announced, the company has been working toward introducing advanced encryption standard (AES)-encrypted card transactions from merchants to Heartland’s processing platform.
