The U.S. Department of Health and Human Services (HHS) has issued new regulations requiring health care providers, health plans and other entities covered by the Health Insurance Portability and Accountability Act (HIPAA) to notify individuals when their protcted health information (PHI) is breached.

Healthcare organizations and state officials eager for a share of the $1.2 billion in federal government grants earmarked for healthcare IT technology will be told Thursday how to apply for the money. The nation’s healthcare IT chief, David Blumenthal, MD, will join Vice President Joe Biden and Health and Human Services Secretary Kathleen Sebelius in Chicago to make the announcement.

The Department of Health and Human Services has delegated the authority for the administration and enforcement of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) Security Rule to the Office for Civil Rights. The OCR’s administration and enforcement of the security rule, which had previously been delegated to the Centers for Medicare and Medicaid Services, will eliminate duplication and improve the department’s efforts to ensure that health information privacy is protected.
